What is a Lasting Power of Attorney?

A Lasting Power of Attorney (LPA) is a legal document that allows you to appoint trusted individuals—called attorneys—to make important decisions on your behalf if you are ever unable to do so yourself.

LPAs are essential for protecting your health, welfare, and financial affairs, giving you and your loved ones peace of mind. They ensure that your wishes are respected, your interests are safeguarded, and decisions are made by people you trust.

Types of LPA

There are two main types of Lasting Power of Attorney:

1. Property & Financial Affairs LPA

  • Lets your attorney manage your finances, including bills, bank accounts, property, and investments.
  • Ensures your financial affairs continue to be managed responsibly if you cannot do so yourself.

2. Health & Welfare LPA

  • Lets your attorney make decisions about your health care, medical treatment, and daily living arrangements.
  • Ensures your personal wishes are respected, even if you are unable to communicate them.

Who Can Be an Attorney?

  • Anyone you trust to act in your best interests, including family members, friends, or professional advisors.
  • You can appoint more than one attorney and decide whether they act jointly or separately.

Why a Lasting Power of Attorney Matters

  • Protects your health, wellbeing, and finances.
  • Reduces the risk of disputes or confusion among family members.
  • Provides clear legal authority for trusted individuals to act on your behalf.
  • Offers peace of mind knowing your wishes will be followed, even if you lose the capacity to make decisions.

Legal Registration

An LPA must be registered with the Office of the Public Guardian (OPG) to become legally effective. Registration ensures your document is valid and recognised by healthcare providers, financial institutions, and legal authorities.
